You assume that the attackers act completely rational.  I don't think
this is necessarily true.  In other areas, attacks certainly continue
because the attackers expect that they can make money, even if their
past experience tells them a different story.

I don't think your condition is necessary, either.  Legalizing online
casinos would likely help a lot.  It's flat-out illegal to mitigate
DDoS attacks against online casions in some countries. 8-/
